Ordinance No. 3982, Updating Documentary Transfer Tax Provisions, was passed and adopted by the Board of Supervisors on March 25, 2008.
This ordinance is based upon a model ordinance drafted in 2000 by the County Recorder’s Association Transfer Tax Committee. The ordinance retitles Butte County Code Article III and reorganizes the manner in which documentary transfer tax rules are set forth in Article III. This ordinance contains many more individual sections than the previous ordinance, both in order to break up some of the individual rules set forth in Division 1, Part 9 of the Revenue and Taxation Code into individual code sections, and also to add new rules enacted by the Legislature, as well as clarifications and model rules recommended by the County Recorder’s Association Transfer Tax Committee. Finally, the ordinance sets forth updated enforcement and collections provisions not contained in the previous ordinance.
